My elderly mothers TAC case was handled extremely competently and with true care by Lee Flanagan one of principal's of Melbourne office. I had come to them for assistance after Shine Lawyers had dragged my mothers case on for over 12 months and were dragging it on further without transparency about fees. Lee finalised the case within 2 months and also only charged 10% of mums payout including money Shine was claiming. He shut down Shine too as they were trying to claim up to 50% of mums payout. We were treated so well by Lee and I would highly recommend the Melbourne office of Arnold Thomas Becker. They were professional, empathic and transparent about their fees, and finalised the case quickly so my mother and father could move on with their lives.
AWFUL EXPERIENCE COSTING A FORTUNE
This firm acted for me in a matter.
By their own incompetence my trial couldn't proceed and was sent for mediation.
They then pressured me to take a settlement which fell outside of the retainer (settle all my cases in future and not just that one, and resign from my employment, including employment law matters of which they had no material on, and admitted they had no experience with).
When I refused to take the offer by reason of the above, they then ceased to act.
They then filed a case against me in Court for their costs.
They were then told with legal documents by two (2) experienced members of counsel, their case was defective and incompetent and could not be successful (in breach of the Civil Procedure Act 2010 (Vic)), but they continued to run with it to trial anyway for 4 years.
Their case was then dismissed by reason of being defective and incompetent, however I have not as yet received my money over $100,000.00 defending their defective claim that never should have been filed in the first place or ran to trial and is in breach of acts initiated by the government.
They never wanted to settle fairly and give me my money back for defending their defective claim.
They dragged me through Courts for years and the case still continues on.
Will update with further review when it the other part is over.
Experience has been absolutely awful mentally and financially not only to me, but to my innocent children.
2 years of Arnold Thomas Becker watch out!!!
I had 2 years experience dealing with Arnold Thomas Becker. The issues I confronted were numerous. Here’s just a few:
1) I was challenging in a Supreme Court writ 3 defendants, 2 were TV Stations. I don’t watch a lot, if any TV, as I once worked in Television. The principal of the firm told me, in our intro meet, that he must tell me that he once schooled with a lawyer acting for 2 of the 3 defendants. But he must have forgotten or deliberately withheld that his ATB actually advertise on TV with the Stations I was challenging. Yep my own lawyers were ‘in bed’ with defendants named on my writ. Yet didn’t feel compelled to convey that! This is supposedly not a Conflict of Interest. However, the perception of a C.O.I remain. And I was denied any opportunity to assess if the firm was fit to act on behalf of my case / clientage.
2. The writ was ‘particularised’ (detailed & served) without me seeing or reviewing any copy. Meaning I would not have prior knowledge of what it was I was actually claiming - until I requested a copy.
3. A ‘junior lawyer’ not long out of articles was assigned to my rather large case (significant claims against 3 large & very powerful defendants). I was never introduced to him personally. The case was out of the ordinary, as it attracted repeat media attention.
4. In the first year, hardly anything happened! There’s supposed to be rules from Court about lawyers ‘protracting’ cases.
5. The following year, early on I admitted myself into hospital for stress and severe abdominal pain. This time coincided with an appointment I was to attend (later rescheduled) with a medico legal at the demands of the defendants. I notified the firm ATB, supposedly acting for me, the junior betrayed me verbally over the phone shouting this (me being in hospital) could be “used against me”. At a meeting some time afterwards, the same junior sitting behind his desk, put his legs up on his desk, spread his legs wide open in plain view as if to show me his crotch, whilst putting his hands behind his head! I mean really mate? What body language are you talking?
6. In receiving the report by the opposing medico legal (the obscene T. Entwhistle), the reported was ‘loaded’ suggested I suffer “delusions of grandeur” and after a near 3 hr grilling he supposedly did not detect what a number of other practitioners had diagnosed. My ‘junior’ lawyer claiming at a later date, its ‘usual’ for Medico legals to ‘bias reports in favour’ of which side employs the medico legal - astonishing!
7. The first barrister who would be involved in my case (to actually represent me), outraged and verbally shouted at me during first met to say, one of the defendants has ‘NO CASE TO ANSWER’! Then why did his co mates at ATB detail a writ with this defendant name on it?
8. The mediation was farcical. The same barrister as above claimed I wasn’t allowed in the mediation room. No reason given. And then ‘advising’ me I should take a settlement offer for, as it turns out, less than 10% of what he actually stated my case was worth some weeks prior. The mediation (out of room proceedings) witnessed by support persons I can produce. Yet we were denied entry.
9. As this was a no win no fee case, I was almost two years into the civil case told straight up if I didn’t sign a hand written agreement to settle for such and such the amount ATB were seeking (and which excluded the 2 of 3 defendants being held to any account that the same firm ATB advertise with) then all legal support would be dropped - holding the proverbial ‘gun to my head’. Involving them leveraging family members to ‘pressure me’.
10. I soon after, discovered Arnold Thomas Becker actually advertise with the defendants. I sacked the firm. But then the court system was used to enforce a supposed settlement upon me.
I was referred to ATB by a reputable lawyer who wouldn’t take the case no win no fee. I returned to the lawyer after the dealings with ATB who have affected my right to redress and compensation from the employers. The lawyer who referred me to ATB said, “I know they’re a sausage factory’. ATB are more than that. They are not to be trusted with valuable cases. I go further in saying they act as patriarchal, and in disrespect and against a clients best interests. Watch out! I have one friend and a family member in-law who have had dealings with this firm on other unrelated personal injury matters. The information I received back was they too were restricted to around the same supposed compensation amounts. Indicating a “Cottage Industry” methodology in processes.
